1. Acceptance of Terms
By downloading, installing, or using the Arka mobile application or any associated web properties (collectively, the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. Arka provides personalized guidance rooted in metaphysical and astrological traditions, which may include Ba Zi, feng shui, numerology, and other systems over time.
These Terms constitute a legally binding agreement between you and Arka ("we," "our," or "us").
2. Eligibility
You must be at least 18 years of age to use the App. By using the App, you represent and warrant that you are 18 or older. If you are under 18, you are not permitted to use the App.
3. Entertainment Disclaimer
The content provided by Arka — including personalized readings, astrological and metaphysical guidance, compatibility assessments, daily and hourly forecasts, and all other content generated through any tradition or system offered in the App — is intended for entertainment and personal reflection purposes only.
Nothing in the App constitutes:
- Medical, health, or therapeutic advice
- Financial, investment, or legal advice
- Professional psychological or counseling services
- A guarantee of any future outcome or event
You should not make significant life decisions — financial, medical, legal, or otherwise — based solely on content provided by the App. Always consult a qualified professional for advice in these areas.
4. Account Registration
Use of the App does not require an account. If you choose to create an account, you agree to:
- Provide accurate information when prompted
- Keep your account credentials secure
- Notify us immediately of any unauthorized use of your account
- Be responsible for all activity that occurs under your account
We support sign-in via Google and Apple only. We do not offer email/password authentication.
5. User Conduct
You agree not to:
- Use the App for any unlawful purpose
- Attempt to reverse-engineer, decompile, or disassemble any part of the App
- Scrape, crawl, or extract data from the App in an automated manner
- Transmit malware, spam, or any harmful code
- Attempt to gain unauthorized access to our systems or other users' accounts
- Use the App to harass, abuse, or harm others
- Misrepresent your identity or affiliation when using social features
6. Intellectual Property
All content, features, and functionality of the App — including but not limited to text, graphics, AI-generated readings, algorithms, and software — are owned by or licensed to Arka and are protected by applicable intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes. You may not reproduce, distribute, modify, or create derivative works from any App content without our prior written consent.
7. User-Generated Content
If you submit a display name, share content, or interact with social features, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content in connection with operating the App.
You represent that any content you submit does not infringe any third-party rights and complies with these Terms.
8. Sharing Features
The App allows you to share reading cards and compatibility content externally (e.g., to social media). When you share content:
- You are responsible for ensuring sharing complies with the terms of the destination platform
- We are not responsible for how third parties receive or use shared content
- Shared content is subject to our intellectual property rights as described in Section 6
9. Social and Friends Features
When you use the Friends and Compatibility features:
- Your display name and public profile data (which may include astrological or metaphysical profile attributes) will be visible to users you connect with
- You consent to your public profile data being used to generate compatibility readings with connected friends
- You can remove a friend at any time; this immediately ends future compatibility reading generation between you
10. Advertising
The App is free and supported by advertising. By using the App, you acknowledge that you will be shown ads. We are not responsible for the content of third-party advertisements. Any interactions with advertisers are solely between you and the advertiser.
11. Push Notifications
The App may send push notifications to your device. You can manage notification preferences within the App or through your device settings at any time.
12. Third-Party Services
The App integrates with third-party services including Google Sign-In, Apple Sign-In, and advertising networks. Your use of those services is governed by their respective terms and privacy policies. We are not responsible for the practices of any third-party service.
13. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy, completeness, or usefulness of any content provided through the App.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ARKA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRIOR TO THE CLAIM, OR (B) $100 USD.
15. Indemnification
You agree to indemnify and hold harmless Arka and its officers, directors, employees, and agents from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your use of the App, your violation of these Terms, or your violation of any third-party rights.
16. Termination
We may suspend or terminate your access to the App at any time, with or without cause, with or without notice. You may delete your account at any time by contacting us at hello@getarka.app.
Upon termination, your license to use the App ends immediately. Sections 3, 6, 13, 14, 15, 17, and 18 survive termination.
17. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of [YOUR STATE], United States, without regard to conflict of law principles.
Any dispute arising from these Terms or your use of the App shall first be addressed through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration in [YOUR STATE] under the rules of the American Arbitration Association. You waive any right to participate in a class action lawsuit or class-wide arbitration.
Nothing in this section prevents either party from seeking injunctive relief in a court of competent jurisdiction.
18. General
- Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Arka regarding the App.
- Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
- No Waiver: Our failure to enforce any right or provision does not constitute a waiver of that right.
- Updates: We may update these Terms at any time. We will notify you by updating the "Last updated" date. Continued use of the App after changes constitutes acceptance.
